1 - PURPOSE AND FEASIBILITY OF THE TERMS OF SALE
The purpose of cecilkemperink-shop.nl `s website is to present works of art by Cecil Kemperink (hereinafter referred to as "seller") to the users of the site (potential "buyers"), and to give them the opportunity to discover and buy them directly from the seller. These terms and conditions define the terms and conditions for the online sale of the works of art available on the site and define the rights and obligations of each party in the sale and sale. The sales through the site are contracted directly between the buyer and the seller. The agreement is concluded between the buyer and the seller, who is the sole seller of the works of art and thus the only one bound by obligations arising there from it.
2 – ACCEPTANCE
The unconditional acceptance of these terms of sale is required to conclude the sales agreement, by both the seller and the buyer. Acceptance is confirmed by a box to be checked on the order form or confirmed in another clear manner for parties.
3 – ORDER
The artworks are offered for sale on the seller`s website (cecilkemperink-shop.nl), depending on their availability. Each of the works of art on offer comes with an explanation of the artwork, its dimensions, material, year, type and signed certificate of authenticity. Images of the artworks on the website are a true representation of the artworks on offer, but seller cannot guarantee that the colors displayed exactly match the real colors of the artworks. This has to do with camera and computer settings. In order to order a work of art, the buyer must select the artwork of his/her choice, place it in his/her shopping cart and carefully provide the necessary personal information to place the order (or identify himself, if he/she has a user account). Before validating the order, the buyer must check the information in the order summary and can correct any errors in the inserted items and read the shipping costs. The buyer will not be charged for the payment until their purchase offer is validated, which is done by cecilkemperink-shop.nl within 48 hours, to ensure the availability of the artwork to the seller. If the artwork is no longer available, an email will be sent within 48 hours informing the buyer, with the order also cancelled.
4 – SALES PRICES AND PAYMENT TERMS
The prices indicated on the Website apply to orders placed on the Website. All prices are in the currency stated on the Website and include VAT where specified (depending on where you reside VAT may however not be applicable to your purchase). If nothing else is stated on the Website the prices do not include shipping fees. Please note also that local charges (such as currency conversion fees, credit or bank card fees, sales tax, customs duty, import duties etc.) may apply depending on where you live and local regulations. Such charges are at your expense and will not be refunded by us. The shipment costs to some countries not included: the UK (Brexit). Shipping costs in consultation.
If the buyer does not pay the full price, the sale is automatically cancelled.

5 - DELIVERY OF WORKS OF ART
The delivery of the works of art shall be carried out at the address on the order confirmation, during business hours and in accordance with the procedures established by the seller or carrier when ordering. Seller informs the buyer about the procedures and delivery schedules used by the various carriers/service providers. Obligations relating to the processing of the order, i.e. taking into account the indicative delivery times, the quality of the packaging for the work of art, as well as the explanation of the work of art, the dimensions, the material, the year, the type and the signed certificate of authenticity are the sole responsibility of the seller. Before the artwork is transported, the seller photographs the artwork before it is even wrapped. Seller also photographs the different stages of packing. We use the box-in-box method. The seller is under no circumstances liable for the transport by the transporter. Delivery schedules are indicative; buyer will be kept informed of the transport and expected delivery date during the process. The buyer has the right to file a complaint against the transport by the transporter. The buyer must, as soon as he receives the order, check the condition of the artwork and report any complaint to the seller immediately and within 48 hours at the latest. For this, photographs are essential, of artwork and packaging. Please keep the packaging.
6 – RIGHT TO WITHDRAWAL
Buyer has a period of 14 days from the delivery of the Work of Art the right to use his/her right of withdrawal with the Seller, without cost or reason. The buyer can use his/her right of withdrawal with cecilkemperink-shop.nl by sending an email to the following address: info@cecilkemperink.nl. return is always done after consultation. Seller is then responsible for the handling of the cancellation of the buyer and processes the refund within 14 days of the date on which the seller is informed of the buyer exercising his/her right of withdrawal. The refund applies to the price of the artwork paid by the buyer and to the shipping costs paid by the buyer. Buyer bears the cost of the cancellation, including the cost of the return transport. Returned works of art that have been damaged or contaminated by the buyer or for which the buyer has not made a complaint in time will not be accepted or refunded. Artworks that are made for your special requests (custom made) cannot be returned. Seller reserves the right to decide at her discretion.
7 - LEGAL GUARANTEES
The seller undertakes to respect and implement the buyer`s legal safeguards, i.e. the guarantee of non-compliance and the guarantee of hidden defects.
8 – FORCE MAJEURE
In case of force majeure, the execution of the agreement may be suspended or, if completed, cause the cancellation of the sale. Cases of force majeure or accidental events are expressly considered, which are usually recognized by the case law of the Dutch courts, i.e. an event which is outside the control of the parties, which could not reasonably have been expected at the time of the agreement and whose consequences cannot be avoided by appropriate measures. The party invoking force majeure shall immediately inform the other Party thereof.
9- INTELLECTUAL PROPERTY
The Seller guarantees that he/she is the creator of the renunciation of the work of art and that there is no violation of applicable laws, regulations and standards or that the rights of third parties are affected. Buyer undertakes to protect cecilkemperink-shop.nl in the event of a claim brought by a third party concerning the abandoned work of art as part of the guarantee of quiet possession. At the time of the sale, the seller assigns to the buyer the right to represent the work of art. However, the seller retains the moral right to the work of art and the rights to its reproduction.
10 - DATA PROTECTION
Cecilkemperink-shop.nl collects and stores the personal data of the buyer to ensure the proper execution of these conditions. Buyer has the right to access, modify, correct and delete his/her personal data processed through the website, and the right to object to the disclosure of such data to third parties on justified grounds by sending a request to the following address info@cecilkemperink.nl. The personal data provided by the buyer shall be destroyed no later than six months after the request for removal. Cecilkemperink-shop.nl reserves the right to retain certain data in order to justify, if necessary, the performance of contractual or legal obligations. The stored data is limited to what is strictly necessary for the operation of the service. Cecilkemperink-shop.nl is determined to take all necessary measures to ensure the best possible protection of the confidentiality of the information provided by the seller and the buyer.
11 – APPLICABLE LAW
These general terms of sale are covered by Dutch law. Any dispute concerning the validity, explanation or enforcement of these general terms of sale shall be referred to the competent Dutch court.
12 – MEDIATION
In the event of a dispute, the buyer has the right to appeal to a consumer ombudsman for the amicable settlement of any dispute concerning the execution of these sales.

1 - DOEL EN UITVOERBAARHEID VAN DE VERKOOPVOORWAARDEN
Het doel van de website van cecilkemperink-shop.nl is om kunstwerken van Cecil Kemperink (hierna "verkoper" genoemd) aan de gebruikers (hierna ook: potentiële "kopers" of koper) van de site te presenteren, en hen de mogelijkheid te geven om ze rechtstreeks bij de verkoper te ontdekken en te kopen. Deze algemene verkoopvoorwaarden definiëren de algemene voorwaarden voor de online verkoop van de kunstwerken die beschikbaar zijn op de site en definiëren de rechten en verplichtingen van elke partij bij de aan- en verkoop. De verkopen via de site worden rechtstreeks gecontracteerd tussen de koper en de verkoper. De overeenkomst wordt gesloten tussen de koper en de verkoper, die de enige verkoper van de kunstwerken is en dus de enige die gebonden is aan verplichtingen die daaruit voortvloeien.
2 – AANVAARDING
De onvoorwaardelijke aanvaarding van deze verkoopvoorwaarden is verplicht om de verkoopovereenkomst te sluiten, door zowel de verkoper als de koper. De acceptatie wordt bevestigd door een vakje dat moet worden gecontroleerd op het bestelformulier of wordt op een andere voor partijen duidelijke wijze bevestigd.
3 – BESTEL
De kunstwerken worden te koop aangeboden op de website van de verkoper (cecilkemperink-shop), afhankelijk van hun beschikbaarheid. Elk van de aangeboden kunstwerken wordt geleverd met een uitleg over het kunstwerk, de afmetingen, het materiaal, jaar, het type en met een gesigneerd certificaat van authenticiteit. Afbeeldingen van de kunstwerken op de website zijn een waarheidsgetrouwe weergave van de aangeboden kunstwerken, maar verkoper kan niet garanderen dat de weergegeven kleuren exact overeenkomen met de echte kleuren van de kunstwerken. Dit heeft te maken met camera- en computerinstellingen. Om een kunstwerk te bestellen, moet de koper het kunstwerk van zijn/haar keuze selecteren, in zijn/haar winkelwagentje plaatsen en de nodige persoonlijke informatie zorgvuldig verstrekken om de bestelling te plaatsen (of zichzelf te identificeren, als hij/zij een gebruikersaccount heeft). Voordat de bestelling wordt gevalideerd, moet de koper de informatie in het orderoverzicht controleren en kan hij/zij eventuele fouten in de ingevoegde artikelen corrigeren en de verzendkosten lezen. De koper wordt niet in rekening gebracht voor de betaling voordat zijn/haar aankoopaanbieding is gevalideerd, wat binnen 48 uur door cecilkemperink-shop.nl wordt gedaan, om de beschikbaarheid van het kunstwerk bij de verkoper te garanderen. Als het kunstwerk niet meer beschikbaar is, wordt er binnen 48 uur een e-mail verzonden waarin de koper wordt geïnformeerd en waarbij de bestelling tevens wordt geannuleerd.
4 – VERKOOPPRIJZEN EN BETALINGSVOORWAARDEN
De verkoopprijs van kunstwerken wordt op de site vermeld in de vermelde valuta. Tenzij anders vermeld omvat de op de site vermelde verkoopprijs tevens alle belastingen, verpakkings-, maar niet de eventuele invoerrechten of invoerbelastingen en vervoers- en transportkosten indien van toepassing. De vervoers-, transport- en verpakkingskosten zijn afhankelijk van het type kunstwerk, de afmetingen, het gewicht en de plaats van levering. De invoerrechten en/of invoerbelastingen zijn ook afhankelijk van de plaats van levering. De betaling van de prijs van het kunstwerk en de eventuele transportkosten, door de koper aan de verkoper, gebeurt via de betaaldiensten die beschikbaar zijn bij cecilkemperink-shop.nl. Enkele landen zijn uitzondering, waaronder het verenigd koninkrijk (brexit) verzending en kosten in overleg. Overdracht van eigendom gebeurt zodra de volledige prijs door de koper is betaald. Wanneer de koper de volledige prijs niet betaalt, wordt de verkoop automatisch geannuleerd.
5 - LEVERING VAN DE KUNSTWERKEN
De levering van de kunstwerken vindt plaats op het adres dat op de orderbevestiging staat, tijdens de kantooruren en volgens de procedures die de verkoper of vervoerder bij het bestellen heeft vastgesteld. Verkoper informeert de koper over de procedures en leveringsschema`s die door de verschillende vervoerders/dienstverleners worden gehanteerd. Verplichtingen met betrekking tot de het verwerken van de bestelling, dat wil zeggen met inachtneming van de indicatieve leveringstermijnen, de kwaliteit van de verpakking voor het kunstwerk, evenals de uitleg over het kunstwerk, de afmetingen, het materiaal, jaar, het type en het gesigneerd certificaat van authenticiteit zijn de enige verantwoordelijkheid van de verkoper. Voordat het kunstwerk wordt getransporteerd fotografeert verkoper het kunstwerk, nog voordat het wordt verpakt. Verkoper fotografeert ook de verschillende stadia van het verpakken. Verkoper hanteert de box-in-box methode. Verkoper is in geen geval aansprakelijk voor het transport door de transporteur. Levertijden zijn indicatief; koper wordt tijdens het proces op de hoogte gehouden van het transport en verwachte afleverdatum. De koper heeft het recht om een klacht in te dienen tegen het transport door de transporteur. De koper moet, zodra hij de bestelling ontvangt, de staat van het kunstwerk controleren en elke klacht onmiddellijk en uiterlijk binnen 48 uur schriftelijk melden aan verkoper. Daarvoor zijn foto’s essentieel, van kunstwerk en verpakking. Verkoper kan koper verzoeken de verpakking te bewaren.
6 - HERROEPINGSRECHT
Koper heeft een periode van 14 dagen vanaf de levering van het kunstwerk het recht om zijn/haar herroepingsrecht bij de verkoper te gebruiken, zonder kosten of reden. De koper kan zijn/hier herroepingsrecht met cecilkemperink-shop.nl gebruiken door een e-mail te sturen naar het volgende adres: info@cecilkemperink.nl. Terugsturen gaat altijd na overleg. Verkoper is dan verantwoordelijk voor de afhandeling van de annulering van de koper en verwerkt de terugbetaling binnen 14 dagen na de datum waarop verkoper op de hoogte is gesteld van de koper die zijn/haar herroepingsrecht uitoefent. De terugbetaling is van toepassing op de prijs van het kunstwerk betaald door de koper en op de door de koper betaalde verzendkosten. Koper draagt de kosten van de annulering, waaronder de kosten van het retourtransport. De geretourneerde kunstwerken die door de koper beschadigd of vervuild zijn of waarvoor koper niet tijdig een klacht heeft ingediend, worden niet geaccepteerd of terugbetaald. Verkoper behoudt zich het recht voor om hierover naar eigen goeddunken te beslissen.
7 - WETTELIJKE GARANTIES
De verkoper verbindt zich ertoe de wettelijke waarborgen van de koper te respecteren en ten uitvoer te leggen.
8 – OVERMACHT
In geval van overmacht kan de uitvoering van de overeenkomst worden opgeschort of, indien deze is voltooid, de annulering van de verkoop veroorzaken. Als gevallen van overmacht of toevallige gebeurtenissen worden beschouwd, die gewoonlijk worden erkend door de jurisprudentie van de Nederlandse rechtspraak, d.w.z. een gebeurtenis die buiten de controle van de partijen valt, die partijen op het moment van de gesloten overeenkomst redelijkerwijs niet hadden kunnen verwachten en waarvan de gevolgen niet kunnen worden vermeden door passende maatregelen. De partij die overmacht inroept, moet de andere partij daarvan onmiddellijk in kennis stellen.
9- INTELLECTUELE EIGENDOM
De verkoper garandeert dat zij de maker is van het afgestane kunstwerk en dat er geen strijd is met geldende wetten, voorschriften en normen of dat de rechten van derden worden beïnvloed. Koper verbindt zich ertoe cecilkemperink-shop.nl te beschermen in geval van een vordering die door een derde partij is ingesteld over het afgestane kunstwerk. Bij de verkoop wijst de verkoper aan de koper het representatierecht op het kunstwerk toe. De verkoper behoudt echter het morele recht op het kunstwerk en de rechten met betrekking tot de reproductie ervan.
10 - GEGEVENSBESCHERMING
Cecilkemperink-shop.nl verzamelt en bewaart de persoonlijke gegevens van de koper om een goede uitvoering van deze voorwaarden te garanderen. Koper heeft het recht op toegang, wijziging, correctie en verwijdering van zijn/haar persoonsgegevens die via de website worden verwerkt, en het recht om bezwaar te maken tegen de mededeling van dergelijke gegevens aan derden op gerechtvaardigde gronden door een verzoek naar het volgende adres te sturen info@cecilkemperink.nl. De persoonsgegevens die door de koper worden verstrekt, worden uiterlijk zes maanden na het verzoek tot verwijdering vernietigd. Cecilkemperink-shop.nl behoudt zich het recht voor om bepaalde gegevens te bewaren om, indien nodig, de uitvoering van contractuele of wettelijke verplichtingen te rechtvaardigen. De opgeslagen gegevens worden beperkt tot wat strikt noodzakelijk is voor de werking van de dienst. Cecilkemperink-shop.nl is vastbesloten om alle nodige maatregelen te nemen om de vertrouwelijkheid van de door de verkoper en de koper verstrekte informatie zo goed mogelijk te beschermen.
11 – TOEPASSELIJK RECHT
Op deze algemene verkoopvoorwaarden is het Nederlandse Recht van toepassing. Elk geschil over de geldigheid, uitleg of tenuitvoerlegging van deze algemene verkoopvoorwaarden wordt voorgelegd aan de daartoe bevoegde Nederlandse rechter.
12 – BEMIDDELING
In geval van een geschil heeft de koper het recht om een beroep te doen op een consumentenombudsman voor de minnelijke schikking van elk geschil over de uitvoering van deze verkoopvoorwarden.
